TERMS AND CONDITIONS

Please read these terms and conditions carefully before placing an order with Whitman Innovations (Pty) Ltd.

1. GENERAL By placing an order with Whitman Innovations you agree to be bound by these terms and conditions. Whitman Innovations reserves the right to update these terms at any time without prior notice.

2. ORDERS AND PAYMENT All orders require full payment at checkout to confirm production. Orders are only confirmed once payment has been received in full. We reserve the right to cancel any order at our discretion.

3. MADE TO ORDER All furniture is handcrafted to order. Production begins once payment is confirmed. Lead times are 4–6 weeks for standard pieces. Custom or complex orders may take longer. Lead times are estimates and may be subject to change.

4. CUSTOMISATION Custom orders are manufactured according to agreed specifications. It is the client's responsibility to ensure all specifications, dimensions and finishes are correct before confirming the order. No changes can be made once production has commenced.

5. CANCELLATIONS AND REFUNDS Due to the made-to-order nature of our products, cancellations are not accepted once production has commenced. All sales are final. Please refer to our Returns and Refund Policy for further details.

6. DELIVERY AND COLLECTION Delivery is available nationwide across South Africa. Delivery costs are calculated at checkout. Customers may also select collection from our workshop at Unit A1, Saxenburg Park 1, 20 Chardonnay Road, Wijnland Park, Blackheath, Cape Town, 7100. Assembly and installation are not included unless specifically arranged. Any damage must be reported within 24 hours of delivery.

7. PRODUCT DIMENSIONS All dimensions provided are approximate. Minor variations may occur due to the handcrafted nature of our products. It is the client's responsibility to ensure that ordered pieces will fit in their intended space.

8. NATURAL MATERIALS Wood and leather is one of God's natural materials. All timber, even of the same species, can vary substantially in colour, grain and texture. Knots and light surface cracks are not deemed as defects. Natural markings such as scratches, branding iron and insect bites are not considered defects on leather. Every furniture piece is individually and meticulously handcrafted — therefore slight variations will occur. Natural characteristics including grain variation, knots, colour variation and minor movement are inherent qualities of solid wood that make each piece unique and are not considered defects. We are passionate about craftsmanship and strive for a quality finished product.

9. INTELLECTUAL PROPERTY All designs, images and content on whitmaninnovations.co.za are the property of Whitman Innovations (Pty) Ltd. No content may be reproduced without written permission.

10. LIMITATION OF LIABILITY Whitman Innovations shall not be liable for any indirect, incidental or consequential damages arising from the use of our products or services.

11. GOVERNING LAW These terms and conditions are governed by the laws of the Republic of South Africa.

12. BALANCE PAYMENTS AND COMPLETION The balance payment is due prior to delivery or collection of the completed piece. Whitman Innovations reserves the right to withhold delivery or collection until full payment has been received. Where a client fails to make payment of the outstanding balance within 7 (seven) days of notification that their order is ready, Whitman Innovations reserves the right to charge a storage fee of R150 (one hundred and fifty rand) per day for each day the item remains uncollected or undelivered beyond the agreed date. Should the balance remain unpaid after 30 (thirty) days, Whitman Innovations shall issue a formal written notice affording the client a final 7 (seven) days to settle the outstanding amount. Should payment not be received within this final period, Whitman Innovations reserves the right to retain the deposit paid and, in the case of standard catalogue items, to sell the piece to recover production costs. Bespoke and custom orders may be referred to a collections process for recovery of the outstanding balance.

13. ABANDONED ORDERS Where a client fails to respond to communication or make payment of the outstanding balance within 30 (thirty) days of notification that their order is ready, the order shall be deemed abandoned. Whitman Innovations shall issue a formal written notice to the client's last known email address affording the client a final 7 (seven) days to make contact and arrange payment. Should no response be received, Whitman Innovations reserves the right to retain the deposit paid as partial compensation for production costs incurred. In the case of standard catalogue items, Whitman Innovations reserves the right to sell or repurpose the completed item to recover costs. Bespoke and custom orders where resale is not possible may be referred to a collections attorney for recovery of the outstanding balance. Whitman Innovations shall not be liable to the client for any loss arising from an abandoned order where due process has been followed.
